Terms of Service

This Terms of Service Agreement (the "Agreement") is made and entered into as of the Effective Date by and between AMERICAN PROPERTY and it's Owner Clients / Affiliates ("Company") and Tenants, Residents, and Lessees ("Tenant / Resident").

1. Scope of Services

Company agrees to provide the following property management services to Tenant / Resident:

  • Find and screen tenants

  • Collect rent

  • Inspect the property

  • Make repairs and maintenance

  • Handle tenant disputes

  • Manage the property accounting

2. Fees

Tenant / Resident agrees to pay Company or it's affiliates on first day of each month for rent other other assessed fees.

3. Term and Termination

This Agreement will commence on the Effective Date of any lease and will continue for a period of noted in that lease. 

4. Tenant / Resident's Responsibilities

Tenant / Resident agrees to:

  • Provide Company with all necessary information and access to the property

  • Pay all rents and other charges due on the property in a timely manner

  • Keep the property in good condition and repair

  • Comply with all applicable laws and regulations

5. Company's Responsibilities

Company agrees to:

  • Use reasonable care in the performance of its services

  • Keep Tenant / Resident informed of all matters relating to the property

  • Notify Tenant / Resident of any potential problems with the property

  • Comply with all applicable laws and regulations

6. Texting Policy Information

  • The Company will send text messages reminding tenants of payment due dates, event reminders, and will respond to tenant text messages with the phone number provided to Company via our online application, tenant portal, and or leases which are individual specific for each lease and for which a copy of may be requested from Company at 206-780-6000.

  • You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

  • If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at {support email address or toll-free number}.

  • Carriers are not liable for delayed or undelivered messages

  • As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive {message frequency}. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

7. Indemnification

Tenant / Resident agrees to indemnify and hold Company harmless from any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with Tenant / Resident's breach of this Agreement.

8. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

9. Governing Law

This Agreement will be governed by and construed in accordance with the laws of the State of Washington.

10. Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision will be struck from this Agreement and the remaining provisions will remain in full force and effect.

11. Waiver

No waiver of any provision of this Agreement will be effective unless in writing and signed by both parties.

12. Notices

All notices and other communications hereunder will be in writing and will be deemed to have been duly given when delivered in person, upon the first business day following deposit in the United States mail, postage prepaid, certified or registered, return receipt requested, addressed as follows:

If to Tenant / Resident: [Tenant / Resident Name] [Leased Premise Address]

or to such other address as either party may designate in writing from time to time.

13. Counterparts

This Agreement may be executed in one or more counterparts, each of which will be deemed an original, but all of which together will constitute one and the same instrument.
